Kelly Rutherford Now Wrongfully Testifying in Media For Children Again

Kelly Rutherford has now officially entered the controversial group of “protective parents” as she has once again started wrongfully testifying in the media about what her children said. She is not claiming “her kids were fearful about being sent back” blah blah blah.We saw this once before when she said in the media that she told her kids she was fighting for them.

This is not Coparenting. 

A coparent need to make transitions easy for their child and from all accounts we heard last week, that’s what happened. Now all of a sudden, Rutherford is double talking and saying something completely different in the media. Nevertheless, regardless of what happened, she should not be “testifying” or tell the media what her kids said or how they acted. This is a typical tactic used by “protective parents” and/or custodial embattled parents. If desperate, they would be willing to say just about anything without regard to the privacy of their own child.

I really hope the media will stop supporting Kelly Rutherford. I think what she is doing is disgusting and horrific. She is not thinking about her innocent children. It’s no wonder the judge gave her former spouse residential custody.

I will say it is nice to see an increasing number of Family Law Lawyers and Child Protectionists speak out against Rutherford, Wendy Murphy, Dan Abrams and Dana Kennedy.

In April of this year, we learned that Kelly Rutherford and her Attorney Wendy Murphy would be speakers at a Battered Mothers Custody Conference in the Northeast. At the time, we were surprised to hear that Rutherford would be attaching herself to this activist group known as “protective parents”. This group has long been known to promote their cases in the media as well as not discouraging acts of civil disobedience to raise attention to their case. Most of these mothers have non-residential custody or are the non-custodial parent, mostly because of their lack of respect for a Family Court in their custody cases. At their recent conference, most of the speakers said that you must use the media in your efforts.

Kelly Rutherford did not get residential custody of her children after a long and grueling custody trial that ended with the October 2013 Statement of Decision by the Los Angeles County Judge. Many of us have now read this custody order which is normally sealed by the stipulation of both parties. In the Summer of 2014, Kelly Rutherford used Attorney and TV Analyst Wendy Murphy to bring her matter to the Federal Court and Media, since returning to the Los Angeles Court was not a realistic option. As expected, the Federal Court does not want to involve themselves in Family Court or Child Custody Cases.

So this summer, Kelly Rutherford went on a public relations or media tour of all the Entertainment Magazines (People/Dana Kennedy, TMZ, E Onine, US) with the message that her children are “living in exhile” in a Foreign Country. She wanted a change in custody because she didn’t want to abide by the 2013 Decision. For most of us in the Family Abduction Community who have seen many of these cases over the years, that statement is ludicrous for children with dual-citizenship. Nevertheless, Rutherford even enlisted the assistance of her friend, Dan Abrams, the ABC News Legal Analyst. Abrams’ wife works for Gucci and Rutherford’s current boyfriend is Tony Brand of Gucci, but that’s a separate story.

In the last several days, we noticed that Dan Abrams was calling Rutherford’s Case a “State Department issue”. But for those of us in the Family Abduction Community, we know exactly what Abrams was trying to do. If the State Department got involved like it did in the Elian Gonzalez Case, Rutherford would likely keep custody of her two children in America until things could get sorted out. That could be months as Rutherford would enroll them in a new school in New York. Abrams did not believe both the Los Angeles and New York Courts would enforce the Monaco Custody Order, since both refused to re-open the 2013 Custody Case as Rutherford wanted.

But Justice Ellen Gesmer of the Manhattan Supreme Court did exactly that. She ordered a writ of habeas corpus for Kelly Rutherford to deliver children to court. Judge Gesmer was going to show the World that the United States or the Manhattan Supreme Court would enforce the Monaco and Los Angeles 2013 Court Order decisively and swiftly.

“Definition: A writ of habeas corpus (literally to “produce the body”) is a court order to a person (prison warden) or agency (institution) holding someone in custody to deliver the imprisoned individual to the court issuing the order.”

For those of us in the Family Abduction Community, we applaud the efforts of Judge Gesmer. For Searching Parents of International Custody Cases, once they have a location of their American Born or even Foreign Born Children, we want International Judges to enforce those U.S. orders as decisively and swiftly as Judge Ellen Gesmer did. We don’t want our kidnapped children that are victims of International Family Abductions to be caught up in red tape of the Foreign Governments or even the Hague Convention and especially the U.S. State Department. As all of us know, sometimes months or even years pass as our children are not rightfully returned to the custodial parent.

So this summer before Daniel Giersch sendt his children to America, it appears he had wanted more guarantees from Kelly Rutherford and her lawyers that she would not try and kidnap or keep them in America. For the past two years or more, that’s been the case. Additionally, if you read the Decision, Rutherford has also withheld custody a number of times which is a Family Abduction or parental kidnapping. This year, a Monaco Judge and one in Los Angeles had a historic International Custody conference call to ensure the children made it to America for their custody time with Kelly. So when Kelly did not send the kids back to Monaco this week, that certainly would not have looked good for the American Legal system if the kids were not immediately returned to Monaco.

This custody case if far from over. But this is why we believe this summer’s Change of Custody Attempt by Kelly Rutherford did not work.

To the Media,

With all the media that Kelly Rutherford has received, we simply to don’t understand why they haven’t read the Los Angeles Court October 24, 2013 Custody Decision. We found this court order posted on the Internet and are reposting it for the media. We encourage every reporter covering this case to read pages 22-31. This should especially include: Michele Corriston (@mcorriston) of People Magazine, Rachel Mcrady of US Weekly and Rebecca Macatee of E Online. These reporters have been victim to spoon-fed press releases or spin by Kelly Rutherford’s PR Team. After reading pages 22-31, how can they willfully and intentionally leave this relevant information out.

It is apparent from reading this that Kelly Rutherford, attempted to write the father out of these children’s lives. Some would allege that she was guilty of extortion for attempting to get him to relinquish his parental rights when her attorney threatened to turn him in to the State Department for immigration or Visa issues.

The media should report the news, not become part of it. In the last several months, we have seen the media do everything possible to try and support Kelly Rutherford. Meanwhile, they have helped her to setup up her current situation of trying defy the October 2013 Family Court Order and kidnap her children.

Parental Kidnapping is a very serious global crime and it’s time for the media to step up and report on it. As of last Thursday, Kelly Rutherford became a parental kidnapper and in these cases with minor children involved — the situation must be de-escalated. By supporting Kelly Rutherford without regard to the facts in the 2013 Custody Decision, a reasonable person would conclude that Kelly Rutherford has some serious mental health issues that must be addressed. Her children have become innocent victims of this parental kidnapping and the media isn’t helping the situation one bit.

In the next 24-48 hours, I would really like to see Kelly Rutherford acknowledge and apologize for her past inappropriate conduct in the custody case. To keep herself out of jail and for the best interests of her children, she must put her children on a plane to Monaco immediately.

Forced Exile from Homeland? International Child Abduction?

Is Attorney Wendy Murphy helping or hurting International Family Abduction Cases when she claims that Kelly Rutherford’s children have been “forced into exile from their homeland”? In following International Custody Cases over the past two decades, I have personally never heard any parent or his or her attorney make this allegation. My first thoughts were to tell Wendy Murphy that she Kelly Rutherford’s children are not living in exile, they are living with their custodial father, an International entrepreneur in Monaco.

For those not familiar with Monaco, it is on the Mediterranean Sea surrounded by France. It is not a member of the  European Union. It maintains and open border and customs union with France. It is known for its glitzy casinos, yacht-lined harbor and its Grand Prix motor race. It appears on the top of many lists as the world’s wealthiest place.

So is Wendy Murphy actually trying to convince Americans that Kelly Rutherford’s children are living in exile, going to school with the children of some of the wealthiest people in the World. I understand that the children attend a very elite private school.

Kelly Rutherford recently declared bankruptcy. She has recently moved from Los Angeles to New York. She is reported to be in a new relationship for the past two months. She has been on her media crusade to bring her children back to America. Now I am not a Family Court Judge, Family Court Evaluator, Child Psychiatrist, Child Psychologist but does anyone other than People Magazine and the other spoon-fed journalists and social media news sites really believe that Kelly Rutherford is emotionally available for her children? Does she actually want them forcibly removed from the their private school and habitual residence in Monaco?

I personally think that the term “forced from exile from their homeland” as it relates to International Custody cases should be reserved for other other cases. There are a number of cases where both Americans and Foreign Nationals have fled the American Justice System with American-born children. As I’ve stated before, it’s time for Kelly Rutherford and Wendy Murphy to move the conversation to International Custody and International Co-parenting.

“In his (sic) decision, obtained by TMZ, the judge chose to make Kelly’s ex Daniel Giersch the “residential parent” because “Daniel (who lives in France) has facilitated the relationship of the children with Kelly … and Kelly simply has not done so.”

1) It is well documented that Kelly Rutherford engaged in parental alienation against her former spouse. She and her attorney Wendy Murphy can deny it, but is appears to be widely reported that’s Kelly Rutherford didn’t necessarily practice first rate co-parenting skills during her custody dispute.

2) Kelly Rutherford is using her celebrity status to ask the President of the United States to overturn or ignore the California Family Court Judge’s Order. She wants to blame the Family Court System rather than take responsibility for her own actions.

3) I personally think that celebrities should be held to higher standards just like professional athletes. In 2014, the National Football League was clearly pressured by the media and special interest groups to take action on domestic violence incidents among their athletes. But in the case of Kelly Rutherford, the media appears to want to give her a free pass on this.

4) Kelly Rutherford should show some respect for our nation’s Family Court System. Rutherford and certainly her attorney Wendy Murphy know that there are no such things as permanent custody orders. Rutherford can always go back to California Family Law Court to petition the court for a change of the custody schedule.

Instead of playing victim in this situation and possibly inciting other custodial embattled mothers, I would like to see Kelly Rutherford step forward and take ownership of her known present or past issue with parental alienation. Now that’s an issue that is worth supporting!

5/12/2015 Update: Kelly Rutherford got her 100K signatures thanks to Kim Kardashian and Ed Westwick. At the end of the day, she is still a parental alienator. I am certain that many people signed her petition because she claims she is broke and can’t see her kids. That’s far from the truth. She can go to Europe and see her kids anytime. I would bet that she talks to them regularly on the phone. She’s probably telling them that mommy is fighting for you which is parental alienation. She really needs to spend less time protesting and more time rebuilding her reputation with the California Judge. It sounds like she is headed in the wrong direction.


Kelly Rutherford – Parental Alienation is why her kids live in France

We recently learned that actress Kelly Rutherford (Gossip Girl) and her well-know celebrity attorney Wendy Murphy are once again on the media circuit telling the story that Kelly Rutherford was victimized by the U.S. Courts. Could Kelly Rutherford that has to fly to France for custody time with her children be the new celebrity activists for the anti-family court groups?

What is not being reported or acknowledged by Kelly Rutherford or her attorney, even in her Dr. Phil interview below is that she engaged in parental alienation during the custody dispute. We noticed that even when she appeared on the Nancy Grace Show with Nancy’s pal Wendy Murphy, the discussion of “parental alienation” was not a topic that was discussed (when would any topic be off the table with Nancy Grace?)

She was so persistent in trying to cut Giersch out of his children’s lives that it even got the attention of the judge in their custody case, something countless fathers will tell you is not easy to do. Generally speaking, courts grant mothers broad leeway in permitting or denying access by the father to his children.”

See the end of the above video she says, “I have always wanted them to have a relationship with their father … I want us to co-parent.” She is quite an actress and she says it convincingly. But then that’s “what she wanted” and not necessarily “what she did“. And on April 15, 2015 a Federal Court ruled that the California Family Law Court’s ruling that gives Rutherford’s former spouse custody of the children to live in France was upheld.

Inasmuch as Kelly Rutherford is blaming the Family Law Court System, perhaps she should really be speaking about Parental Alienation and what not to do! We really hope that Kelley Rutherford will stop bashing the family courts, playing victim and take ownership over the parental alienation issue. Perhaps it’s time she took a lesson from Ray Rice or Adrian Peterson in that regard.
