The Judicial Tenure Commission Hearings are Completed

The Michigan Judicial Tenure Commission Hearings brought forward by Paul Fisher and Margaret Rynier against Judge Lisa Gorcyca are now completed. The ruling will be made in 21 days by Judge Dan Ryan. There were 2 days of detailed witness testimony with video allowed in the court room, live streaming to a website and numerous posts on social media despite the GAL and children’s attorney in the civil case request to keep the children’s names out of the media since the custody case is still pending. Here are some conclusions:

  • Paul Fisher and Margaret Rynier of the Judicial Tenure Commission should have found a way to close these hearing to the public or at the very least stopped the public from video taping or live streaming the hearing. These children are going to school in the local community and additional steps should have been taken to protect the family and children’s privacy.
  • The Michigan Judicial Tenure Commission should not be used as another forum for litigants like the Mother who after using 17 attorneys received numerous proclaimed unfavorable rulings or verdicts. Nevertheless the door has been officially open to report Judges to these judicial conduct review boards.
  • It is horrific how disrespectful the minors in the case have been toward the professionals involved. And their treatment of their father by turning their back to them, locking their arms together and looking down on the ground is outrageous. After hearing of this, how can any parent and especially the mother in this case condone such behavior?
  • One of the Family Law issues that was been brought forth in this case is when a Family Law Judge issues a custody order, are the children too responsible for following that order? And can those child be held responsible for the civil contempt of that order? We never found the answer to that in the Madonna/Ritchie case. The son eventually agreed and is now adhering to the custody schedule. That said, the Michigan Judicial Tenure Commission is certainly not the venue for deciding this.
  • It seems like this case is more political than the professional conduct and ensuring the law is being followed by the Family Law Judge in this case. This became apparent when Margaret Rynier tried to inject religion into her cross-examination as well as the travel schedule of the father. It was wrong for the Judicial Tenure Commission attorneys to try and interview the children to afford them a basis for testifying for them (which the mom and her attorney Lisa Stern most likely wanted). The professional conduct of Rynier and Fisher certainly should be further investigated.
  • The mother and her supporters in this case have to find a way to compromise their position and show compassion for the remarried father in this case for the benefit of these children. There needs to be coparenting in this case and everyone needs to follow all court orders.

The Judge in this case will be challenged to follow the law and do the right thing and clear Judge Lisa Gorcyca in this case. With social media, video and the global media, it is just too easy for disgruntled litigants to create additional forums for their cases. The Judge should act swiftly and decisively to not give those Judicial System Critics any additional forums for their cause.

The  Family Law Judge in this case is now tasked with trying to create a miracle and put this family unit back together. These family members will need to find a way to tolerate each other. This would include graduations, colleges and holidays. This is a lifetime of future opportunities for these children.

Here are videos from today’s Hearing. It’s shocking for a judge’s conduct to be put on trial like this publicly. Also with the pending custody hearing with Judge Joan Young and with minors involved, it is odd to hear portions of the custody case adjudicated.

What is the most shocking is co-examiner Margaret Rynier’s line of questioning toward a judge and what appears to be her attempt at using the race card in the second video.

Editor’s Note: It is very sad to see legal resources and taxpayer dollars used in this manner to publicly disparage the reputation of a judge. There are critics of our nation’s Family Court System but if any system is broken, it’s the Michigan Judicial Tenure Commission proceedings. Some of the inappropriate questions almost sound like the Supreme Court Hearings for Justice Clarence Thomas. By today’s standards, Margaret Reiner’s questioning of Judge Gorcyca about the religion of the Tsimhonis were extremely insensitive. Finally, as this trial proceeds, it appears that the Director of the Michigan Judicial Tenure Commission has some political agenda in this case with his attempts to interview the children in this case as well as facilitate a meeting with the Israeli Consul General in Chicago and the children.


Madonna Finds Way to Reconcile with Son & Former Spouse

In this age of co-parenting and joint custody, with other not so famous families quarreling over custody (Tsimhoni, Wolferts, Rucki) it’s great to see Madonna find a way to compromise and work toward sharing custody with her former spouse. While we still think that her former spouse may have participated in a Teenager Family Abduction, Madonna has taken the high road and most importantly respected the Family Courts involved.

Could it be that the Family Court System does work and it only doesn’t work if parents are not cooperative and don’t show respect for court orders?

 


Parents in bitter Michigan custody battle told to behave

The Detroit Free Press is reporting that the new judge assigned to the Tsimhoni Case, Circuit Judge Joan Young told Maya Tsimhoni (Maya Eibschitz) and Omer Tsimhoni, along with their attorneys, that the court would no longer tolerate derisive or disparaging comments from any of the parties about each other, their attorneys or the court.

  • We applaud Judge Joan Young for taking the first steps to de-escalate the conflict in this case. It is important that all parties respect the each other and the court.
  • There has been a disturbing trend in these high conflict divorce and family abduction cases with the protective parent movement groups trying the case on social media. Some of these posts are similar to the cyber stalking, cyber bullying and digital domestic violence that has been seen in other similar cases.
  • The Tsimhoni Case started with what we believe was a Family Abduction in Israel. The father came home from work one day and the mom left Israel with the kids for the United States. The father eventually moved back to Detroit, Michigan. As time has progressed, the conflict in this case has continued to escalate. Let’s hope that both parents can work toward the goal of attending their first kids’ high school graduation and being able to tolerate each other for that event.

“I have been aware of Ms. Pruter’s work in this area for a while, but through our work together on this case I have had the opportunity to review Ms. Pruter’s reunification protocol and have also been able to engage her in extensive dialogue regarding her approach and an attachment-based model for the construct of “parental alienation.”

“I would like to take this opportunity to provide Ms. Pruter with my unequivocal, full and complete support for her model of family reunification (“High Road to Family Reunification”).  Based on my review of her reunification protocol, it is theoretically sound for addressing the issues surrounding an attachment-based model of “parental alienation.” I would anticipate that her reunification protocol will be highly effective in resolving the family issues surrounding an attachment-based model of “parental alienation.”

“One of the primary issues regarding enacting Ms. Pruter’s reunification protocol is that it FIRST requires the child’s protective separation from the distorted parenting practices of the narcissistic/(borderline) allied (and supposedly “favored”) parent. Narcissistic Personality Disorder – DSM-5

The Protective Parent Movement aka Family Court Critics as well as the Domestic Violence Community argue that Parental Alienation Disorder is not a listed in the DSM-5.

What drives a parental alienator? Most commonly, some type of narcissistic personality features, says Dr. Childress. According to Dr. Childress, parents who indoctrinate children into alienating the other parent are linked to narcissist borderline pathogenic parenting.

The symptoms of narcissism include: grandiosity, entitlement, absence of empathy, haughty, arrogant behavior and delusional belief systems. Although narcissistic personality disorder is listed in the DSM-5, which is considered to be the “Bible” of Psychiatric Disorders, so far Parental Alienation Disorder is not listed. Researchers expect that to soon change.

Researcher Amy Baker says that parents who try to alienate their child from the other parent subtlety, or not so subtletly gives a three-part message to the child.

“I am the only parent who loves you and you need me to feel good about yourself; the other parent is dangerous and unavailable; and pursuing a relationship with the other parent jeopardizes your relationship with me.”

When reading the symptoms of narcissism below, you think if the protective moms in these cases we have followed over the years had these symptoms. On the list: April Meyer, Bonnie Rubenstein, Cindy Dumas, Dorothy Lee Barnett, Eileen Clark, Ellen Dever, Genevieve Kelley, Holly Ann Collins, Kelly Rutherford, Maya Tsimhoni and Sandra Rucki. Parental Alienation Disorder “PA” may not yet be in the DSM-5, but these moms certainly appeared to have most of these symptoms.

  • haughty
  • arrogant behavior
  • delusional belief system

In summary, it sounds like Parental Alienation = Narcissist Borderlline Pathogenic Parenting. So in the spirit of coparenting and moving forward in these cases, let’s not give these moms a license to alienate their kids.
